Affiliate League — Assumption of Risk, Waiver, and Liability Release ("Agreement")
THIS IS A LIABILITY RELEASE. BY CHECKING THE APPROPRIATE BOX AND COMPLETING REGISTRATION, YOU ARE WAIVING CERTAIN LEGAL RIGHTS AND COMPLETELY RELEASING POTENTIAL CLAIMS. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE AGREEING TO ITS TERMS.
In consideration for the opportunity to register for, participate in, travel to and from, and otherwise engage in the Affiliate League competition season, including without limitation any regular season match, playoff match, city championship, or other fitness event operated under the Affiliate League name or through the platform at affiliateleague.net (collectively, the "Event"), hosted at or operated through member fitness affiliates and gyms (each a "Host Facility"), and each of its officers, directors, members, employees, agents, contractors, volunteers, and representatives, as well as each Host Facility and its owners, operators, staff, coaches, judges, and volunteers, and all team captains, co-captains, and fellow participants (collectively, the "Released Parties" and each a "Released Party"), I agree as follows:
1. Dangerous Activity
I acknowledge that the Event involves strenuous physical activity, including but not limited to weightlifting, gymnastics movements, cardio and metabolic conditioning, climbing, jumping, sprinting, and the use of barbells, dumbbells, kettlebells, pull-up rigs, rowing and ski ergometers, assault bikes, boxes, and other fitness equipment. The risk of injury from these activities is significant. Risks include, without limitation, muscle strains and tears, joint injuries, spinal injury, rhabdomyolysis, musculoskeletal injuries, cardiovascular stress, cardiovascular trauma, neurological impairment, heart attack, stroke, serious personal injury, paralysis, and death. I understand that these risks may result from my own actions or omissions, the actions or omissions of other participants, the condition of equipment or facilities, and other causes that may not be predictable or within anyone's control.
2. Multiple Venues and Travel
I understand that Affiliate League competition is conducted on a home-and-away basis at member affiliate gyms and fitness facilities. As a participant, I will travel to Host Facilities other than my home gym throughout the season. I acknowledge that each Host Facility may have different equipment, flooring, ceiling heights, layouts, and environmental conditions. I accept all risks associated with travel to and from Host Facilities and with competing in unfamiliar environments. I agree that it is my responsibility to familiarize myself with any Host Facility before competing there.
3. Peer-Judged Competition; No League Staff Present
I understand and acknowledge that Affiliate League matches are peer-judged. Competing teams judge each other, and no Affiliate League staff or officials are present at regular season or playoff matches. I accept all risks arising from this format, including risks associated with judging decisions, movement standards interpretation, and the absence of trained officials or medical personnel at the match venue. I agree that it is my sole responsibility to ensure I am physically prepared to compete and that I will not rely on any Released Party to monitor my health or safety during the Event.
4. Representation as to Physical Condition
I represent and warrant that I am in good physical condition and am medically fit to participate in the Event. I have consulted with, or have had the opportunity to consult with, a qualified physician regarding my participation. I do not suffer from any health condition that may be aggravated by strenuous physical exercise, including but not limited to heart conditions, high blood pressure, respiratory conditions, musculoskeletal conditions, or metabolic disorders. I agree to comply with any medical guidance I have received. If my physical condition changes before or during the Event, I will not participate until I have been cleared to do so by a qualified medical professional.
5. Consent to Medical Treatment
I consent to receive first aid, medical, and/or surgical treatment, or any other services rendered to me in the event of an injury, accident, or illness I incur during my participation in the Event. I understand that no Released Party is obligated to provide such treatment. I acknowledge that any injuries I sustain may be compounded by the absence of medical personnel at the match venue, by delayed emergency response, or by negligent first aid.
6. Assumption of Risks
Understanding, acknowledging, and accepting all the risks described in this Agreement, I freely and voluntarily choose to participate in the Event. I hereby voluntarily and expressly agree to accept and assume all risk of loss, damage, theft, injury, or death that may occur to me or my property as a result of or in connection with my participation in the Event or my travel to or from any Host Facility, including the risk that I may be injured by the actions or negligence of the Released Parties, other participants, or third parties. I understand that this Agreement is binding on me and, to the fullest extent permitted by law, on my heirs, executors, administrators, personal representatives, guardians, successors, and assigns (collectively, the "Releasors").
7. Liability Release and Waiver of Claims
On behalf of myself and the Releasors, and in consideration for being permitted to participate in the Event, I hereby waive, release, and forever discharge any and all claims or causes of action, now known or hereafter known, against the Released Parties, including without limitation any claim arising from or related to bodily injury, disability, illness, disease, accident, death, financial loss, property loss, damage, delay, or other harm of whatever nature, whether directly or indirectly related to my participation in the Event, my travel to or from any Host Facility, or any activity related thereto, including claims arising from the negligence of any Released Party or from the absence of medical or safety personnel at the match venue; provided that nothing in this Section 7 releases any Released Party from liability arising from their own willful or intentional injury to me or my property.
I expressly waive the provisions and protections of Section 1542 of the California Civil Code and any similar law of any jurisdiction, which provides:
A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.
I understand the significance and consequence of this waiver and expressly assume full responsibility for it.
8. Equipment and Facilities
I understand that equipment used in Affiliate League matches is provided by Host Facilities and may vary from venue to venue. I accept all risks associated with the use of fitness equipment, including risks arising from equipment condition, improper use, equipment failure, and the use of equipment that differs from what I typically train with. It is my responsibility to inspect any equipment I use before competing and to decline to use any equipment I believe to be unsafe.
9. Personal Property
I am responsible for the security and safety of my personal property at any Host Facility. No Released Party shall have any liability for the loss, theft, damage, or destruction of any personal property I bring to or leave at any Host Facility or other location associated with the Event.
10. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties, jointly and severally, from and against any and all claims, actions, demands, losses, costs, damages, expenses, settlements, judgments, causes of action, and liabilities of any kind, including attorneys' fees, in law or in equity, arising out of or resulting from my participation in the Event, my breach of this Agreement or the Affiliate League competition rules and policies, or any claim by a third party related to the Event or my participation in it.
11. Promise Not to Bring Suit
I agree and covenant, on behalf of myself and the Releasors, not to bring any claim, suit, or legal proceeding against any Released Party for any loss or damage arising from or related to my participation in the Event or my travel to or from any Host Facility, and I forever release and discharge the Released Parties from liability under any such claim.
12. Competition Rules and Policies
I have read, understand, and agree to abide by the Affiliate League Competition Rules published at affiliateleague.net, including all rules governing match conduct, scoring, judging, sportsmanship, and eligibility. I understand that violation of these rules may result in forfeiture, disqualification, or removal from the league.
13. Governing Law and Jurisdiction
This Agreement shall be governed by and construed under the laws of the State of California, without regard to its conflict of law provisions. Any action or proceeding to enforce this Agreement or arising from any dispute related to it shall be brought exclusively in Sacramento County, California. I waive any objection to venue, personal jurisdiction, or the convenience of such forum.
14. Severability
If any provision of this Agreement is held invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if incapable of enforcement, shall be severed from this Agreement. The remaining provisions shall continue in full force and effect.
15. Entire Agreement
This Agreement constitutes the entire agreement between me and the Released Parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, and representations relating thereto. This Agreement may only be amended by a written instrument signed by an authorized representative of Affiliate League.
Acknowledgment
By completing registration through affiliateleague.net and checking the acknowledgment box, I confirm that:
- I am at least 18 years of age and have the legal capacity to enter into this Agreement, or if I am under 18, my parent or legal guardian is agreeing to this Agreement on my behalf and assumes all obligations hereunder.
- I have read this Agreement in its entirety, I understand all of its terms, and I have had the opportunity to ask questions and seek legal counsel before agreeing.
- I agree to this Agreement freely and voluntarily, without duress or coercion.
- I have read, understand, and agree to comply with the Affiliate League Competition Rules and Policies.
- I am not pregnant and will not participate while under the influence of alcohol or substances that impair my physical ability or judgment.
- I am aware of the inherent risks of the Event and voluntarily choose to participate despite those risks.
- By agreeing to this Agreement, I am giving up certain important legal rights, including the right to recover damages in the event of injury, death, or property loss or damage, and I am making a promise not to sue.
